Emotion regulation is an umbrella term to describe interactive, goal-dependent explicit and implicit processes that are intended to help an individual manage and shift an emotional experience. The primary window for appropriate emotion regulation development occurs during the infant, toddler, and preschool years. Atypical emotion regulation development is considered a risk factor for mental health problems and has been implicated as a primary mechanism underlying childhood pathologies. Current treatments are predominantly verbal- and behavioral-based and lack the opportunity to practice in-the-moment (...) management of emotionally charged situations. There is also an absence of caregiver-child interaction in these treatment strategies. Based on behavioral and neural support for music as a therapeutic mechanism, the incorporation of intentional music experiences, facilitated by a music therapist, may be one way to address these limitations. Musical Contour Regulation Facilitation is an interactive therapist-child music-based intervention for emotion regulation development practice in preschoolers. The Musical Contour Regulation Facilitation intervention uses the deliberate contour and temporal structure of a music therapy session to mirror the changing flow of the caregiver-child interaction through the alternation of high arousal and low arousal music experiences. The purpose of this paper is to describe the Therapeutic Function of Music, a theory-based description of the structural characteristics for a music-based stimulus to musically facilitate developmentally appropriate high arousal and low arousal in-the-moment emotion regulation experiences. The Therapeutic Function of Music analysis is based on a review of the music theory, music neuroscience, and music development literature and provides a preliminary model of the structural characteristics of the music as a core component of the Musical Contour Regulation Facilitation intervention. Perhaps more than any other scholar, Michael Moore has argued that there are deep and necessary connections between metaphysics, morality, and law. Moore has developed every contour of a theory of criminal law, from philosophy of action to a theory of causation. Indeed, not only is he the central figure in retributive punishment but his moral realist position places him at the center of many jurisprudential debates. Comprised of essays by leading scholars, this volume discusses and challenges the (...) work of Michael Moore from one or more of the areas where he has made a lasting contribution, namely, law, morality, metaphysics, psychiatry, and neuroscience. The volume begins with a riveting contribution by Heidi Hurd, wherein she takes an unadorned and unabashed look at the man behind this monumental body of work, full of both triumphs and sadness. A number of essays focus on Moore's view of the purpose and justification of the criminal law, specifically his endorsement of retributivism and legal moralism. The book then addresses Moore's work in the various aspects of the general part of the criminal law, including Moore's position on how to understand criminal acts for double jeopardy purposes, Moore's claim that accomplice liability is superfluous, and Moore's views about the culpability of negligence, as well as the relationship between that view and proximate causation. Furthermore, the subject of defenses in criminal law is addressed, including self-defense, and also the intersection of psychiatry, psychology, cognitive neuroscience, and the criminal law. Also discussed are features of morality, and Moore's work in general jurisprudence. Finally, Moore concludes the volume with an essay that defends and delineates the features of his views. (shrink)

This brief festschrift introduction does not attempt to review and characterize Michael Moore’s extraordinary and influential immense body of scholarship at the intersections of law, morality, and metaphysics. This is done most ably by Heidi Hurd in the following chapter. Here we simply describe each of the contributions to this volume as they relate to the body of Moore’s work, virtually every aspect of which is addressed by the various authors. The introduction concludes with personal last words by (...) the editors about their history with Moore and his influence on them and others. Concrete personal examples are given. In this response to the review of Moore, Causation and Responsibility, by Larry Alexander and Kimberly Ferzan, previously published in this journal, two issues are discussed. The first is whether causation, counterfactual dependence, moral blame, and culpability, are all scalar properties or relations, that is, matters of more-or-less rather than either-or. The second issue discussed is whether deontological moral obligation is best described as a prohibition against using another as a means, or rather, as a prohibition on an (...) agent strongly causing a prohibited result that was not about to happen anyway while intending to do so. In the past, hypothesis testing in medicine has employed the paradigm of the repeatable experiment. In statistical hypothesis testing, an unbiased sample is drawn from a larger source population, and a calculated statistic is compared to a preassigned critical region, on the assumption that the comparison could be repeated an indefinite number of times. However, repeated experiments often cannot be performed on human beings, due to ethical or economic constraints. We describe a new paradigm for hypothesis testing which uses only (...) rearrangements of data present within the observed data set. The token swap test, based on this new paradigm, is applied to three data sets from cardiovascular pathology, and computational experiments suggest that the token swap test satisfies the Neyman Pearson condition. Negligence is a problematic basis for being morally blamed and punished for having caused some harm, because in such cases there is no choice to cause or allow—or risk causing or allowing—such harm to occur. The standard theories as to why inadvertent risk creation can be blameworthy despite the lack of culpable choice are that in such cases there is blame for: (1) an unexercised capacity to have adverted to the risk; (2) a defect in character explaining why one did (...) not advert to the risk; (3) culpably acquiring or failing to rid oneself of these defects of character at some earlier time; (4) flawed use of those practical reasoning capacities that make one the person one is; or (5) chosen violation of per se rules about known precautions. Although each of these five theories can justify blame in some cases of negligence, none can justify blame in all cases intuitively thought to be cases of negligence, nor can any of these five theories show why inadvertent creation of an unreasonable risk, pure and simple, can be blameworthy. A solution to the problem of “overcriminalization” appears to be decriminalization of certain crimes. This Essay focuses on a group of crimes that has been labeled “proxy crimes” as a candidate to be eliminated. What are proxy crimes? Douglas Husak defines them as “offenses designed to achieve a purpose other than to prevent the conduct they explicitly proscribe.” Michael Moore describes them as involving situations where we “use one morally innocuous act as a proxy for another, morally wrongful act (...) or mental state.” Put that way, proxy crimes seem highly problematic, and Larry Alexander and Kimberly Ferzan bluntly put it, “We reject proxy crimes.” This Essay asks whether we should reject proxy crimes by presenting and evaluating Alexander and Ferzan’s treatment of the subject. After describing several different types of crimes that may be characterized as proxy crimes and Alexander and Ferzan’s rejection of most of them and their arguments for doing so, this Essay argues that their rejection of proxy crimes is incomplete, which leaves their theory open to a range of possibilities regarding the proper place of proxy crimes in criminal law. This Essay concludes that getting a handle on the problem of proxy crimes and overcriminalization requires a theory of the state and an articulation of the proper relationship between the state and its citizens that can give guidance on when the state can demand obedience from citizens to support the state and when failures to comply with such demands render one criminally culpable. Without such a theory, proposals to address overcriminalization cannot travel very far. (shrink)

Jaegwon Kim argues that unreduced mental causes are excluded from efficacy because physical causes are sufficient in themselves. One response to this causal exclusion argument is to embrace some form of overdetermination. In this paper I consider two forms of overdetermination. Independent overdetermination suggests that two individually sufficient causes bring about one effect. This model fails because the sufficiency of one cause renders the other cause unnecessary. Dependent overdetermination suggests that a physical cause is necessary and sufficient for a given (...) effect, but it necessitates a mental cause of the effect as well. This model fails because the necessity of the mental cause renders the physical cause individually insufficient. (shrink)

This collection explores the subject of conflicts of interest. It investigates how to manage conflicts of interest, how they can affect well-meaning professionals, and how they can limit the effectiveness of corporate boards, undermine professional ethics, and corrupt expert opinion. Legal and policy responses are considered, some of which (e.g., disclosure) are shown to backfire and even fail. The results offer a sobering prognosis for professional ethics and for anyone who relies on professionals who have conflicts of interest. The contributors (...) are leading authorities on the subject in the fields of law, medicine, management, public policy, and psychology. The nuances of the problems posedby conflicts of interest will be highlighted for readers in an effort to demonstrate the manyways that structuring incentives can affect decision making and organizations' financial well-being. It has been proposed that performance in the think – no think task represents a laboratory analogue of the voluntary form of memory repression. The central prediction of this repression hypothesis is that performance in the TNT task will be influenced by emotional characteristics of the material to be remembered. This prediction was tested in two experiments by asking participants to learn paired associates in which the first item was either emotionally positive or emotionally negative . The second word was (...) always emotionally neutral . Consistent with the repression hypothesis, significant memory suppression was observed in both experiments following ‘no think’ instructions for memories associated with emotionally negative material. No suppression was observed for memories associated with emotionally positive information. Implications of these findings for the relationship between performance in the TNT task and the controversial notion of memory repression are considered. (shrink)

This study demonstrates the importance of social context to the study of networks vital to business success. Results from analyses of the personal and business characteristics associated with different types of networks, a topic that has been neglected in past research, show the importance of structural perspectives emphasizing that women and men in the same situations have similar networks. Yet there are some network differences even among these women and men who operate the same kinds of businesses. I endorse an old view that distributive justice can best be understood as people getting what they deserve. John Rawls has several famous arguments to show that such a view is false. I criticize those arguments, but agree that more work needs to be done on the clarification and explanation of the concept of desert in order for the old view to be more than a platitude. I then criticize attempted analyses of the concept of desert by Feinberg, Kleinig, and (...) Miller. I claim that desert must be taken as a primitive concept. However, even though desert is primitive, there still needs to be some account of what sorts of things make a person deserving . Some proposed desert bases include need, personhood, diligence, moral worth, autonomous action, and entitlement. I criticize George Sher's work on autonomous action, diligence, and moral worth, then propose and defend a modified version of the view that all legitimate desert bases are either virtues or vices. ImportancePrevious studies of post-acute COVID-19 syndrome have focused on critical cases with severe disease. However, most cases are mild to moderate in disease severity.ObjectiveWe aimed to examine cognitive outcomes in cases of non-critical, mild-to-moderate COVID-19. Design, Setting, and Participants: In this cross-sectional study, we enrolled 72 adults aged 22 to 65 years in Central Texas who had non-critical, mild-to-moderate COVID-19 infection between 13 January 2021 and 20 April 2021.Main Outcomes and MeasuresWe remotely administered cognitive-behavioral testing to determine the frequency of (...) cognitive impairment and examine demographic, clinical, and psychosocial contributors to impairment.ResultsThe frequency of objective cognitive impairment was 40%. The largest number of participants showed impairment on a measure of executive functioning. Attention and processing speed was more impaired in males. Males endorsed lower adherence to social distancing guidelines, which was in turn associated with cognitive impairment across participants. Younger age was correlated with impairment but was also associated with racial/ethnic minority status and increased psychological symptoms. Moderate COVID-19 severity was associated with attention/processing speed impairment, increased pain, and higher number of COVID-19 symptoms.Conclusion and RelevanceMild or moderate COVID-19 infection may be associated with cognitive impairments, especially in the domain of executive functioning. Hamdûn el-Kassâr’ın (ö. 884) temsil ettiği Melâmetiyye-i Kassâriyye, Hacı Bayram-ı Velî’nin (ö. 1430) halifesi Ömer Dede Sikkînî’nin (ö. 1475) temsil ettiği Melâmetiyye-i Bayramîyye ve Muhammed Nûrü’l-Arabî’nin (ö. 1888) temsil ettiği Melâmetiyye-i Nûriyye olarak 3 dönemde incelenmektedir. Melâmîliğin bu devrelerine dair akademik düzeyde çalışmalar yapılmış olsa da mûsikî yönüne dair çalışmaların çok az olduğu görülmüştür. Bu çalışmanın evreni Nûriyye Melâmîleri, örneklemi ise Nûriyye Melâmîlerine dair mûsikî ile ilgili çalışmaları kapsamaktadır. (...) Çalışmada Nûriyye Melâmîlerinin edebi ve sanatsal yönü araştırılmış, literatür taraması aşamasında Melâmî tekke ve derneklerinde icra edilen ilahilere güfte olarak kaynaklık eden Melâmî Efendilerine ait divanlar incelenmiştir. Çalışmamızın amacı Melâmî divanlarında yer alan ve ilahi formunda bestelenmiş güfteleri tespit etmek ve bu ilahilerin yaygınlığını belirlemektir. Nitel araştırma yöntemi kullandığımız çalışmamızda birincil veri kaynaklarını; Melâmîler tarafından bizzat kaleme alınan divanlar ve yine Melâmî ihvanı ile yapılan görüşmeler oluşturmaktadır. İkincil veri kaynaklarımız ise Melâmîlik hakkında yazılan tasavvuf kitapları, makaleler ve Melâmî derneklerinin resmi sayfalarında yer alan mevcut bilgilerdir. Tespit edilen divanlardaki bestelenmiş ilahiler için ise Melâmî Divanları, Devlet Nota Arşivi, Cüneyd Kosal Nota Arşivi, Divan Makam ve Notam v1.0 (Aytaç ERGEN) programı üzerinden taranmış, eşleşen ilahiler çalışmamıza dâhil edilmiştir. Nûriyye Melâmîlerine ait 14 adet divan incelenmiştir. Bu divanlar Abdurrahîm Fedâî, Ali Örfî, Ömer Lütfî, İştipli Hacı Salih Rıf’at, Abdulmâlik Hilmî, Hulûsi Maksud, Hüseyin Şemsi Ergüneş, Hasan Fehmi Tezdoğan, Üsküplü İsmail Hakkı, Hafız Ahmet Fethî, Hüseyin Sabri Soyyiğit, Ahmet Soyyiğit, Yaşar İhsan Gülver ve Dâvud Yılmaz’a ait divanın arasından 8 tanesinde yer alan 97 adet ilahinin notaya alındığı tespit edilmiştir. Verilerin değerlendirilmesi aşamasında; yapılan bu bestelerin hem Melâmî tekke ve meclislerinde hem de tekke dışında icra edildiği, bu bağlamda Nûriyye Melâmîlerinin edebi ve sanatsal yönünün tekke dışında da etkin olduğu görülmüştür. A large U.S. government investigation into arms procurement procedures with corporate contractors has recently led to guilty pleas to fraud and illegal use of classified documents. Operation Ill Wind has brought public attention to the criminal and unethical conduct of large defense contractors in their dealings with the government. This article will review how the defense contract bidding process operates and why illegal activity has been able to compromise the process. Ali Kuşçu Şerhu’t-Tecrîd adlı eserinde; görme kuvvetini açıklar, görsel algıya dair matematikçilerin ve tabiatçıların görüşlerini sundukları deliller bağlamında tartışır, aynada görüntünün resmedilmesi, tek bir adet nesnenin iki adet görülmesi gibi konuları irdeler, (...) görsel algıda dav’ ve rengi önkoşul olarak, renk algısını da dav’a bağlı olarak açıklar, dav’ın niçin cisim olamayacağından bahseder, birincil ve ikincil ışıklar terminolojisini dahil ettiği anlatısını karanlıkta görme problemiyle tamamlar. Şerhu’t-Tecrîd’de son olarak ele aldığı karanlık problemi, Ta‘lîkât alâ mebâhisi’l-egâlîti’l-hissiyye min Şerhi’l-Mevâkıf adlı eserinde tartıştığı ilk problemdir. Bu eserinde Ali Kuşçu, gemideki gözlemcinin göreceli hareketi, benzer üçgen geometrisiyle aynada görünen nesnenin büyüklüğünün belirlenmesi, farklı renklerin meydana gelmesi gibi problemlere ilgi duyar, mesaisini bu problemlerin geliştirilmesine ayırır. Optik problemleri tartışırken, hareket teorisi, göz fizyolojisi gibi farklı doğa felsefesi problemlerine kapı aralar, anlatılarını yer yer geometrik gösterimler ile destekler. Two aspects of mothering—using drugs during pregnancy and giving up the rearing of one's children—are the focus of this analysis of 58 addicted Chicana mothers who spent their adolescent years in barrio gangs. From a traditional stance, such women were doubly deviant, since they violated gender-role prescriptions by joining a barrio gang and by becoming involved in heroin and street life. Half of these women added to this deviance by using heroin during pregnancy, and 40 percent relinquished at least one (...) of their children. This article explores what distinguishes these classically “bad mothers” from addicts who maintain some degree of conventionality in their mothering. We found that Mexican gender-role traditionalism is not the only influence on these women. Many came from cholo or underclass families with a tradition of street involvement. In addition, their involvement in gang and heroin worlds may influence their behavior as mothers. We found that women who used drugs during pregnancy were more likely than abstainers to be cholas and to reject traditional gender-role values. However, those who gave up their children were more likely than those who kept their children to be from traditional families. We discuss the implications of these findings for research on deviance and the underclass among Hispanic women. (shrink)

W.M. Gorman has been a major figure in the development of economies during the past forty years. His publications on separability, aggregation, duality and the modelling of consumer demand are recognized as fundamental contributions to economic theory. Many of his unpublished papers have achieved similar status as privately-circulated classics.This volume brings together for the first time all Gorman's important work, much of which has never been published before, on aggregation across commodities and agents, including separability, budgeting, representative agents, and the (...) construction of capital and labour aggregates. Each chapter is preceded by an editorial introduction which describes its origin and place within the literature as well as the main results themselves. A forthcoming second volume, Modelling and Methodology, will cover topics on duality, demand, trade, and welfare.This book will appeal to academic economists interested in either specific aspects of Gorman's work or in the evolution of economic theory.
